Typographical Errors
In the event that a Ergo Depot, LLC product is mistakenly listed at an incorrect price, Ergo Depot, LLC reserves the right to refuse or cancel any orders placed for product listed at the incorrect price. Ergo Depot, LLC reserves the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, Ergo Depot, LLC shall issue a credit to your credit card account in the amount of the incorrect price.
Term; Termination
These terms and conditions are applicable to you upon your accessing the site and/or completing the registration or shopping process. These terms and conditions, or any part of them, may be terminated by Ergo Depot, LLC without notice at any time, for any reason. The provisions relating to Copyrights, Trademark, Disclaimer, Limitation of Liability, Indemnification and Miscellaneous, shall survive any termination.

Ergo Depot, LLC may deliver notice to you by means of e-mail, a general notice on the site, or by other reliable method to the address you have provided to Ergo Depot, LLC.
Miscellaneous
Your use of this site shall be governed in all respects by the laws of the state of Oregon, U.S.A., without regard to choice of law provisions, and not by the 1980 U.N. Convention on contracts for the international sale of goods. You agree that jurisdiction over and venue in any legal proceeding directly or indirectly arising out of or relating to this site (including but not limited to the purchase of Ergo Depot, LLC products) shall be in the state or federal courts located in Multnomah County, Oregon. Any cause of action or claim you may have with respect to the site (including but not limited to the purchase of Ergo Depot, LLC products) must be commenced within one (1) year after the claim or cause of action arises. Ergo Depot, LLC's failure to insist upon or enforce strict performance of any provision of these terms and conditions shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any of these terms and conditions. Ergo Depot, LLC may assign its rights and duties under this Agreement to any party at any time without notice to you.
Indemnification
You agree to indemnify, defend, and hold harmless Ergo Depot, LLC, its officers, directors, employees, agents, licensors and suppliers (collectively the "Service Providers") from and against all losses, expenses, damages and costs, including reasonable attorneys' fees, resulting from any violation of these terms and conditions or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing the site using your Internet account.
Returns
We
will be happy to accept your seating return within 30 days of original
receipt**. The only charges incurred will be the outbound and return
shipping charges. All returns must be approved by Ergo Depot and a
return authorization number must be issued prior to return shipment.
Returns must be received in "like new" condition and in all original
factory packaging. Please do not discard any of the original packaging
materials. Refund will be issued, less shipping fees, upon inspection
and approval of all items by our staff. Please allow up to 5 business
days for your credit card provider to process the refund. Please
direct all return-related questions to sales@ergodepot.com.
Sorry, but we do not accept returns on Open-Box Specials/Demo chairs,
parts, or any Ergo Tools (foot rests, monitor arms, keyboard systems,
computer peripherals, etc).
** This policy only applies to single-chair HAG, Humanscale, and VIA seating orders, upholstered in any fabric except leather, delivered within the United States. Special order chairs upholstered in leather, as well as seating products from Interstuhl, Varier, and Neutral Posture,
are subject to a 20% restocking fee. All returns from Canada will also
incur a 20% restocking fee in addition to shipping charges.
Changes or cancellations
Orders can be cancelled within 24 hours of being placed on our site with no additional charges. After this time cancellation of an order may result in additional fees. Our cancellation fees will never be more than the amount billed by the product manufacturer.
Please review your information and order confirmation thoroughly as address and specification changes can be difficult once an order is submitted for production. We will do everything we can to make any adjustments to an order but often times there will be fees associated with changes of this nature. We will notify a client of any fees associated with a change before the request is processed
Shipping
All items qualify for free shipping to the lower 48 United States. We will gladly ship to Hawaii, Alaska, and Canada, for an additional charge. Our cart and checkout page offer an estimated FedEx International Ground quote for Canada*. Depending on location and product, your order may qualify for "free shipping" to Canada. Please contact us if you would like a customized quote or if you need information regarding shipment to Alaska or Hawaii.
*FedEx International Ground quotes do not include GST, brokerage fees, or any other fees. The client will be responsible for any additional fees associated with the order upon import into Canada. Contact our service representatives with any questions.
Delayed and Damaged Shipments
Please
note that all lead times provided are only estimates. We make every
effort to work closely with our manufacturers to ensure timely and
accurate delivery of your items. Occasionally, manufacturing delays
can occur and we will do our best to notify you of extended lead times
and to "rush" orders as soon as stock becomes available.
All damaged shipments must be addressed with the carrier
within 48 hours of receipt. Please inspect and document any damages
that may have occurred in transit. Images of damaged packaging and
contents will be very helpful in the resolution process. Ergo Depot
will help in the facilitation of your claim in any way we can.
Manufacturer Warranties and Claims
Seating
and Ergo Tools products are warranted to the original user to be free
from design, material, and workmanship defects. Warranty claims can be
filed directly with the manufacturer or you may contact Ergo Depot and
we will do all we can to help communicate with the manufacturer and
facilitate the claim. Claims will be resolved according to the
policies of the manufacturer. In
many cases, replacement parts will be sent to repair damaged items and
repairs will need to be performed by the end user. In the case that a
repair cannot be made by the user, the manufacturer's standard warranty
repair policy will be utilized.
Third-Party Links
In an attempt to provide increased value to our visitors, Ergo Depot, LLC may link to sites operated by third parties. However, even if the third party is affiliated with Ergo Depot, LLC, Ergo Depot, LLC has no control over these linked sites, all of which have separate privacy and data collection practices, independent of Ergo Depot, LLC. These linked sites are only for your convenience and therefore you access them at your own risk. Nonetheless, Ergo Depot, LLC seeks to protect the integrity of its web site and the links placed upon it and therefore requests any feedback on not only its own site, but for sites it links to as well (including if a specific link does not work).
